In consideration of being permitted to come onto Abundant Life Fitness, LLC d/b/a Abundant Life Adventure (“Abundant Life”) property and allowed to participate in fitness and physical training activities, at specific times and locations as directed by Abundant Life (“Activity”), I, __________________________________, for myself, my personal representatives, assigns, heirs, and next of kin: [print name]

1. ACKNOWLEDGE, agree, and represent that I understand the nature of the Activity and that I have sufficient skills, am in good health, and am in proper physical condition to engage in such Activity. I understand that I should consult with my primary care physician if I have any concerns about my health and/or physical condition. I further agree and warrant that if at any time I believe conditions for the Activity to be unsafe, I will immediately discontinue further participation in the Activity.

2. I FULLY UNDERSTAND that: (a) the participation in fitness and physical training involves risks and dangers of serious injury, including permanent disability, paralysis, and death (“Risks”); (b) these Risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the Activity, the condition in which the Activity takes place, or the negligence of Abundant Life; (c) there may be other risks and social and economic loses either not known to me or not readily foreseeable at this time, and I fully accept and assume all such risks and all responsibility for loses, costs, and damages I incur as a result of my participation in the Activity.

3. I HEREBY RELEASE, DISCHARGE, AND COVENANT not to sue the Abundant Life, as well as its officers, directors, agents, employees and assigns from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the Abundant Life or otherwise. I am participating in the Activity of my own free will and volition, and, in the event of any injury, property damage, medical expenses, or other loss, I agree and covenant to incur my own expenses.

4. I HEREBY INDEMNIFY AND HOLD HARMLESS Abundant Life, as well as its officers, directors, agents, employees and assigns, from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in the Activity. I have read and understood the foregoing, and I understand that by agreeing here it obligates me to indemnify the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission.

I have read this agreement, fully understand its terms, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.
